Terms of Use

1. Acceptance of Terms

By downloading, installing, accessing, or using any application published by Basic Apps ("we," "us," or "our"), you ("you" or "User") confirm that you are at least 13 years of age, have read and understood these Terms of Use ("Terms"), and agree to be bound by them. If you do not agree to these Terms, do not use our applications.

These Terms govern your use of all Basic Apps applications (collectively, the "Apps"), including:

3. Subscriptions and Billing

Certain features within our Apps require a paid subscription. Current subscription plans are as follows:

Basic Intake Pro includes a 7-day free trial with up to 15 AI interactions during the trial period.

By subscribing, you agree to the following terms:

• Payment is charged to your Apple ID account at the time of purchase confirmation.
• All subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You may cancel your subscription at any time via iPhone Settings → Apple ID → Subscriptions.
• Cancellation takes effect at the end of the current billing period. You retain access to subscription features until that date.
• Refunds are processed by Apple in accordance with Apple's refund policy. To request a refund, visit reportaproblem.apple.com.
• Any unused portion of a free trial is forfeited upon purchasing a subscription.

4. Health and Safety Notice

Drift includes visual stimulation effects such as moving images, flashing patterns, and light variations. If you have photosensitive epilepsy, migraines triggered by visual stimuli, or any similar condition, consult your doctor before using Drift.

Drift is designed for short decompression sessions. Do not use Drift while driving, operating machinery, or in any situation requiring your full attention.

5. AI Assistant (Basic Intake)

Basic Intake includes an AI-powered assistant powered by Anthropic's Claude API. By using the AI assistant, you acknowledge and agree to the following:

• Your messages are transmitted to Anthropic for processing in order to generate responses.
• All AI-generated responses are informational only and do not constitute medical advice.
• We are not responsible for the accuracy or completeness of AI-generated suggestions.
• You should always use your own judgment and consult qualified healthcare professionals before acting on any AI-generated information.

6. User Responsibilities

You agree to:

• Use the Apps only for lawful, personal purposes.
• Maintain the security of any passcodes and biometric authentication you configure (Basic Checkbook).
• Ensure the accuracy of all self-entered data.
• Use Drift in a safe environment where visual stimulation will not pose a risk.
• Not rely solely on suggestions provided by the Apps for health or financial decisions.

You agree NOT to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of any App.
• Use the Apps in any manner that could damage, disable, overburden, or impair them.
• Attempt unauthorized access to any part of our Apps, servers, or CloudKit databases.
• Circumvent subscription limits, trial restrictions, or any access controls.

7. Intellectual Property

All Apps, including their content, features, design, code, graphics, and audio content, are owned by Basic Apps and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes in accordance with these Terms.

Fonts, audio content, and other licensed assets included in the Apps are licensed for in-app use only and may not be extracted, copied, or redistributed.

8. Disclaimer of Warranties

THE APPS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APPS WILL OPERATE ERROR-FREE OR WITHOUT INTERRUPTION, THAT DATA WILL BE PRESERVED WITHOUT LOSS, THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE, OR THAT WELLNESS FEATURES WILL PRODUCE ANY PARTICULAR OUTCOME.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BASIC APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or corruption of records
• Loss of profits or revenue
• Financial losses arising from use of or reliance on Basic Checkbook
• Harm resulting from reliance on AI-generated supplement suggestions in Basic Intake
• Wellness outcomes or lack thereof from use of Drift

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APPS EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to terminate or suspend your access to any or all of the Apps at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, all rights granted to you under these Terms cease immediately.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will indicate so by updating the "Last updated" date at the top of this page. Your continued use of the Apps following any changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes arising from or related to these Terms or your use of the Apps shall be resolved exclusively in the state or federal courts located in Pennsylvania.
